How do you get a trademark registration in Ireland?
If you have developed a brand for your unique idea that consists of words, a logo or a combination thereof, you can therefore have the exclusive rights protected through trademark registration. The rights to a trademark are granted in Ireland to the person or company that uses it first. There is no legal obligation to register a trademark in Ireland. Although this duty is not there, in practice it is very wise to do this anyway.
After all, anyone who decides to register a trademark in Ireland will be able to demonstrate ownership more easily. This is important in the unlikely event of infringement. In order to register your trademark in Ireland, it is not necessary to have it already in use. However, this does not alter the fact that its active use is beneficial; in this way you reduce the risk of rejection of your application on the grounds of poor distinctive character.
What types of registration are there in Ireland?
Anyone who decides to apply for a trademark in Ireland can do so in various ways. If your international ambitions are (for the time being) limited to Ireland, the most logical step is to apply for trademark protection locally at the Irish Patent Office, or IPO for short. Do you intend to register your trademark in Ireland and other parts of Europe? With a registration of the EUIPO you enjoy trademark protection in all 27 countries of the European Union. In addition, Ireland is also a member of the Madrid Protocol. This means that expansion of international registration via the Madrid System is also possible for this country.
How to apply for a combined trademark in Ireland?
If you do want to register a combined brand name in Ireland, before submitting your application, you have to ask yourself something important: do you want to be able to use one of the elements (the words or the logo) separately from the other for your commercial activities? If that is the case, it is a good idea to request a separate registration for this specific element, so that this separate element will also be protected.
Although it is not mandatory to do this, entrepreneurs who ignore this tip often come home from a rude awakening. Because they do not register the relevant part of their trademark in Ireland, other entrepreneurs who also want to register a trademark in Ireland do not have to take this into account. In fact, they cannot take this into account; the element cannot be found separately in the registers. In such cases, you can only object to the use by third parties if they offer products or services that are very similar to the ones you offer.
The trademark search
Of course, it is also important for you as an entrepreneur to check the existence of registered trademarks or their filing. You must therefore perform a good trade mark search. Is there an identical or very similar brand? Then you have to make adjustments and register a different brand in Ireland. Via the website of the IPO you can search at both local and European level.
In addition to this database, you can also consult the gazette of the IPO. In this, entrepreneurs are informed of trademarks for which an application for registration has been made. The gazette of the IPO is published every two weeks.
What are the steps in the trademark application process in Ireland?
You can apply for a trademark in Ireland both online and by sending the necessary forms to the IPO. When your application for registration has been received, you will receive an official application date and an application number. Then your brand is tested. Part of this review process is a search in the databases for similar and identical brands. Your application will also be tested against the criteria of the Trade Marks Act.
Is your application accepted? Then it will appear in the next issue of the gazette of the IPO. Third parties then have three months to object. For example because they believe that their trademark protection is being violated. Is there no opposition within the set time? Then you will pay the registration fee and a successful registration of your trademark in Ireland is a fact.
Validity and Renewal
On the day the IPO issues the registration certificate, a period of ten years of protection starts. You can extend that protection at the end of that period. Extensions also have a term of ten years. You can request an extension from six months before the expiry date. After this date, there is a six-month grace period during which your application for an extension can still be processed at a higher cost.
Using your mark
You are not obliged to use your brand immediately. However, do you leave it unused for more than five years after registration? Then there is a risk that your registration will be canceled based on inactivity. Third parties who wish to register a trademark can initiate this procedure.
