How do I check a trademark?

Checking a trademark can be done online, in the trademark registers for country or jurisdiction. Each country has its own register, except for the Benelux, ARIPO and OAP jurisdictions. In addition, all countries of the European Union have their own trademark register collectively.

The countries Belgium, the Netherlands and Luxemburg are covered by the trademark register in the Benelux.

This also applies to the member states that fall under the African Regional Intellectual Property Organization (ARIPO), namely Botswana, Gambia, Ghana, Kenya, Liberia, Lesotho, Malawi, Mozambique, Namibia, Rwanda, Sierra Leone, Sudan, Swaziland, Tanzania, Uganda, Zambia and Zimbabwe.

Finally, there is the Organisation Africaine de la Propriété Intellectuelle (OAPI). These are: Benin, Burkina Faso, Cameroon, the Central African Republic, Chad, the Comoros, the Congo, Ivory Coast, Equatorial Guinea, Gabon, Guinea, Guinea-Bissau, Mali, Mauritania, the Niger, Senegal, and Togo.

Where can I see if a business name is taken?

You should ascertain your business name in the registers of the countries or jurisdictions in which you operate, where you have products manufactured or where you expect infringement. You can do so in the local trade register and in the trademark register. 

If your name appears in either register, you may not be able to use it and may have to choose a different name.

How do I find a trademark number?

Each trademark has a number attached to it. Once you’ve found the brand you’re looking for, you’ll see a few details. This includes the trademark owner, the trademark attorney, the address details of these parties and the trademark number.
