How do you get a trademark registration in Iceland?
In Iceland, exclusive rights to a trademark are granted to the person or company that first uses it in this territory. Although registration is not mandatory, it appears to be of great value in practice. Whoever decides to register a brand name in Iceland clearly demonstrates ownership. In the unlikely event that conflicts arise around this theme in the future, you will be better protected with registration.
The distinctive character of your mark
If you want to register a trademark in Iceland, you do not need to use this trademark at the time of application. However, this does not alter the fact that the active use is indeed useful. After you have submitted an application to register your trademark in Iceland, it will be tested on various points. A very important criterion is distinctiveness. Brands that are already actively in use have, by definition, a higher distinctiveness than brands that are not.
Filing a trademark in Iceland at a national or international level
f you want to register a trademark in Iceland, you can turn to the ISIPO: the Icelandic Intellectual Property Office. This has only been the official name of the trademark office since July 2019; before that it was known as ELS, the Icelandic Patent and Trademarks Office. Iceland is not part of the European Union, which means that it is not possible to register a trademark in Iceland via the EUIPO. Iceland is a member of the Madrid Protocol. Expansion of international registration via the Madrid System is therefore possible in Iceland.
Filing by an authorized trademark attorney
Anyone who wants to apply for a trademark in Iceland can do so via the website or by sending the necessary papers by e-mail to the ISIPO. If you want to register multiple trademarks, you must submit several applications. Once you have sent your application, only very minimal adjustments are allowed afterwards. If you are not a resident of Iceland, you are obliged to hire an authorized agent. A signed power of attorney must therefore also be supplied with your application. The agent can then sign the application on your behalf.
Registering a combined trademark in Iceland
A trademark can consist of a single element (for example a word or a logo), but also of a combination thereof. In the latter case, most entrepreneurs usually always use the two elements together. Yet there are also plenty of entrepreneurs who also use the individual elements – or one of them – separately. If you intend to do so, or if you do not rule this out in the future, it is wise to submit a second application for trademark protection. This application then only concerns the specific word element or figurative element.
The reason for doing this is to prevent the use of this element by third parties, while you want to use it for commercial purposes yourself. If you choose not to register the element separately, you can only object to use by third parties on the basis of confusing similarity. That is, when the product or service they offer is so similar to yours that it could confuse or mislead the consumer.
What are the requirements for a trademark application in Iceland?
If you want to register a trademark in Iceland, the trademark must be clearly distinguishable, i.e. the goods or services should not be too similar to those of others. The brand must also be so characteristic that consumers immediately understand that a specific product or service is being offered with it. A brand should not be too descriptive, nor should it be misleading. Words that are used in everyday language, like flags and other state symbols, are also not allowed.
Of course it is also important to make sure that the same brand or very similar brands do not yet exist. Via the website of the ISIPO you can perform a first, thorough trade mark search at both local and international level. Also, if you want to register a trademark in Iceland, it is very important to take enough time to think about the description of your goods or services. Once the request has been submitted, the selection cannot be expanded.
Opposition by an older trademark
Your trademark registration application will be published on the ISIPO website. As a result, third parties may object if they believe that this registration violates their rights. They are given two months to do this. It is impossible to say in advance how successful a possible opposition will be.
The validity of your trademark protection
Your trademark must be in use within five years of registration. If not, there is a risk of cancellation due to inactivity. Only in exceptional circumstances will inactivity be condoned. There is also a six-month grace period.
