The costs of trademark registration in Kuwait depend on the number of Nice classes that are relevant to the trademark. Most marks need 1 to 3 classes, but it is possible to get  protection in all of classes 1 through 45 of the Nice classification.

How do you get a trademark registration in Kuwait?

Registering a mark in Kuwait is necessary to obtain exclusive rights over a trademark as the country operates on a first-to-file basis. Only in exceptional cases can an unregistered trademark still receive trademark protection. It is not necessary to have already registered the trademark you want to register in Kuwait. For foreign applicants, the registration process must take place through a registered lawyer or trademark specialist.

Registration of products and services in classes

If you want to register a trademark in Kuwait, it is important to know that it is not possible to register a product or service in multiple classes. Separate applications must then be submitted for each class. It is also not possible in Kuwait to register brands in classes 32 and 33 for alcoholic beverages (class 3 has, incidentally, been abolished in its entirety). The same applies to pork in class 29. Today, tobacco products can be registered in class 34 again.

What are the required documents required for registration?

To register a trademark in Kuwait, you need to submit some documents to the patent office. This concerns the following matters:

  • The personal data and the nationality of the applicant
  • An image of the trademark to be registered
  • The list of goods and / or services
  • A copy of a legalized power of attorney
  • A copy from the trade register

Apply for a combined trademark in Kuwait

If you want to register a combined trademark in Kuwait, by this we mean a trademark that consists of both a word element and a figurative element, then the trademark protection that you receive after going through the procedure is only valid for the specific combination of these elements. That is to say: the word element and the logo are not separately protected from each other. If you would like this, you must submit a separate application for this.

Although this is not mandatory, it does not prevent you from running a risk if you fail to do so. If you want to be able to use the word element or logo separately, but do not register it separately, a third party can use this element as (part of) his or her brand. Only if the person in question offers products and / or services that are so similar to yours and there is such a confusing resemblance, you can object to this. The success of such an objection is variable.

What is the procedure for registering a trademark in Kuwait?

If you intend to register a trademark in Kuwait, you go through a set procedure. The Kuwaiti patent office then first conducts a formal review. If there is a rejection, you then have sixty days to appeal against it. If your application is accepted, it will be posted on the official website of the patent office. However, this does not happen once, but in three consecutive editions.

A period of sixty days starts from the moment of the last online publication, which can be used by third parties to object. If this is not done, the estimated duration of the entire registration period to register a trademark in Kuwait is six to twelve months.

What is the validity period of trademark protection in Kuwait?

Have you successfully registered your brand name in Kuwait? This is then valid for ten years, starting on the date of application. The trademark protection can be extended indefinitely. Extensions are also valid for ten years. You can request an extension in the last twelve months before the end date and until the last day of the month in which the validity expires. If you are late, there is a further grace period of six months. You can still renew your brand at higher costs.

How can you prevent cancellation due to inactivity?

If you are going to file a trademark in Kuwait, it does not have to be in use at the time of registration. However, a trademark cannot remain unused for more than five years, in order to prevent discontinuation due to non-use. The initiative for this is not taken by the patent office, but by any third parties. They can argue in court that your trademark is not being used seriously, or that there was no bona fide intention to use the trademark. To avoid this risk, you only need to use the brand minimally.
