How to obtain a trademark registration in UAE
Going through a legal process to register your brand name in the United Arab Emirates, and therefore also Dubai, protects your products or services and ensures you are recognized as the owner of your trademark.
In the United Arab Emirates, exclusive trademark rights are granted to the person or company that first uses the trademark in this territory. Although registration is not mandatory, this clearly demonstrates ownership and prevents future conflicts in this regard. To register a brand name in the United Arab Emirates, turn to the IPOUAE, the Trademark Department of the Ministry of Economy. The United Arab Emirates is a member of the Madrid Protocol since December 2021.
How does combined trademark protection work?
If your trademark is a combined trademark (i.e. containing verbal and figurative elements), the trademark protection applies only to the exclusive combination of these elements, as filed with IPOUAE. If you also want to protect the individual elements, a separate application procedure is necessary. Entrepreneurs who choose not to submit a separate application run the risk that third parties will use this brand element for their own commercial purposes. You can only object if the products or services offered by that party are the same as what you offer, or very similar to it.
What can't you register as a trademark?
If you want to register the protection of a trademark in the United Arab Emirates, you must take into account the regulations applicable in the country. The United Arab Emirates only imposes restrictions. A trademark cannot contain any of the following:
- elements offensive to public morals and religions
- public symbols, such as flags
- symbols such as the red cross and the red crescent
- third party names or titles
- direct translations of other well-known trademarks
What are the steps in the trademark registration process in UAE?
To register a trademark name in the UAE, you go through a procedure that is the same for every entrepreneur. The first step is always to verify that the intended trademark is not already in use by someone else. If this is the case, you cannot register it. After a thorough trademark search, you can submit your application online via the website of the Ministry of Economy. This is the only official authority in the United Arab Emirates that manages trademark protection applications. The assessment will take place after payment has been made. You will usually be notified of the decision within 30 days.
How does the publication and opposition work?
After approval of your application to register your trademark in the United Arab Emirates, you go through one more process step. Your trademark must be published in the official trade gazette and two local newspapers. The newspapers in which you can publish your trademark are: Al Khaleei, Al Watan, Al Ittihad, Al Bayan, Al Fair and Al Wahda. After publication in two Arabic-language newspapers, an opposition period of thirty days starts. Third parties can object to your application being granted within this period.
Keep in mind that the Ministry of Economy only publishes the announcements at the end of the month, so you sometimes have to wait up to two months before you can actually call a trademark registration a fact. If there is no opposition, the Ministry of Economy will provide you with a certificate. This certificate contains important details such as your name, the name of your trademark, the description of goods and services covered and the registration number.
What is the validity of trademark protection in the United Arab Emirates?
The trademark protection is valid for ten years. You can renew this after ten years. You can also extend indefinitely. You can submit your application for an extension as early as twelve months before the end date of the current term. After that date, there will be a three-month grace period where you can renew your trademark at a higher rate without reapplying.
What are the requirements for using your trademark after filing it
Although a trademark does not have to be in use before you register it and you do not have to use it immediately after registration, this does not mean that non-use is allowed without restriction. If you are still not actively using your trademark in the United Arab Emirates for five consecutive years after registration, third parties are allowed to object on the basis of this inactivity. After investigation, the Ministry of Economy may decide to cancel your trademark and assign it to another party.
