How do you get a trademark registration in Singapore?
Although it is not necessary to register a trademark in Singapore to obtain the rights to it, it is recommended. With a registration you prove ownership and there is more basis for enforcing your rights in the field of intellectual property. Moreover, the use of a mark contributes to its distinctiveness. You can submit an application for trademark protection to the IPOS, the Intellectual Property Office of Singapore.
Singapore as an interesting Asian business center
Singapore is known for its strong trademark registration jurisdiction. The country is seen as a global business center with business-friendly legislation, an attractive tax system and political stability. Singapore has taken one of the biggest steps in creating intellectual property protection. In April 2013, the government launched a ten-year plan, which includes the realization of a strong protection system for rights applicable to intellectual property. This also makes the application procedure clear and smooth. Singapore is also a member state of the Madrid Protocol. Expansion of international trademark protection is therefore possible in this territory.
Goods and services according to the Nice Classification
If you want to register a trademark in Singapore, fill in a TM4 form with your application and pay the associated costs for the registration procedure. Your application must include a list of goods and services for which you wish to use the trademark. This list is a very important part of your application, as it will determine the scope of your trademark rights. You classify the goods and services according to the international Nice Classification.
If you make mistakes in this, the validity of specific rights may be called into question at a later stage. This can even result in a removal from the trademark register. It is therefore very important to classify the goods and services that you offer in the correct classes. Application spanning multiple classes is possible in Singapore. You then pay an application fee for each class.
What is the procedure to follow when registering a trademark in Singapore?
If you want to register a trademark in Singapore, you go through a fixed procedure. Every entrepreneur follows the same steps. First of all, you perform a trademark search. This ensures that there is no identical or very similar trademark. This also significantly increases the chance of your application being approved. You then fill in the required form and send it to the IPOS, which then carries out a formality investigation. This includes checking whether you have provided all the necessary information.
After going through the formalities investigation, specialists will conduct a substantive investigation. During this phase, they check whether there are identical or similar trademarks that have already been registered or are in the application process. It is then assessed whether the trademark can be registered in accordance with the rules of the law.
Publication and objection
If no limitations arise during the substantive research, you will be informed about the acceptance of your application. It appears for public inspection in the Singapore Trade Bulletin. There is then an opposition period of two months during which any interested party may object to the registration. Is there no objection? Then you have been successful in registering your brand name in Singapore. The registration is realized and as an entrepreneur you will receive a certificate.
Filing a multi-element mark in Singapore
Do you want to apply for trademark protection in Singapore and does it consist of both a word element and a figurative element? In that case, the exclusive right that you obtain with a successful registration only applies to the exact combination of elements, as you have submitted it to the IPOS. If you also want to use one of the elements separately for promotional purposes, it is advisable to start a separate registration procedure for this. Only in this way can you protect the elements separately from each other.
Do you not do this and decide a third party to use this element? Then you are not always empty-handed. If this person or company offers goods or services that are similar or very similar to yours, you can object to this. You then register this objection on the basis of a similarity that is confusing for the consumer. How successful such an objection is varies per situation.
What is the validity period and how does the use of your trademark work?
Have you managed to register a trademark in Singapore? This is then valid for ten years and can be extended indefinitely. Also, renewals last for ten years and can be requested at any time during the current period. There is also a grace period of six months. Even if you apply for it well in advance, the extension will take effect when the previous term expires.
It is important not to leave your trademark unused in Singapore for more than five years after registration. If you do this, third parties can submit a request for cancellation. Non-use is only accepted in a few cases. Using your brand to prevent cancellation needs to be minimal, but sincere.
