How do you get a trademark registration in Liechtenstein?
In Liechtenstein, you can apply to register your trademark with the Bureau of Intellectual Property or the Office of Economic Affairs (LIPO). It is not mandatory to actually do business in Liechtenstein if you register your brand name. You must regularly show some activity, because if your brand name is unused for too long, the registration will be declared invalid.
You must submit various documents with the application. First of all, it is important that you communicate all contact details, including, for example, a deed of incorporation of your company, or an extract from the Trade Register. In addition, you must hand over your brand name. Make sure it is exactly right. Think of separate colours, shapes or three-dimensional aspects. You also need to show what kind of goods or services you trade under your brand name. After all, in most cases this cannot be deduced from the brand name you use.
Does Liechtenstein use the first-to-file principle?
Without a registration of your brand name, your trade is not protected. In Liechtenstein, the rule applies that the first person to register a trademark also has all the rights of use. Other companies or individuals can therefore register your brand name without any effort and even start offering the same merchandise. Of course you want to avoid that.

What is the validity period of a trademark in Liechtenstein?
From the moment your application is submitted, the registration of your trademark in Liechtenstein is valid for a period of 10 years. After that you have the option to renew each time for 10 years. You can do this up to 6 months after the expiry date of that period, but you will pay a fee for a late renewal.
It is also possible that you have registered a trademark without actively using it on the market. However, if you do not use your brand name for 5 years or more, your registration will be cancelled. By being active with your brand name from time to time, you can prevent the protection of your brand name from lapses.
