How do you get a trademark registration in Jordan?

The agency where you can register a brand name is the Trademark Registration Section of the Ministry of Industry, Trade and Supply of Jordan (MIT). You must submit several documents to MIT before your application can be viewed. In the first instance, you must be able to demonstrate 4 copies of your deed of incorporation or extract from the Trade Register. This contains your contact details and you tell us what your intentions are with your brand.

In addition, you submit two copies of the brand’s appearance. Keep things like colors, shapes and three-dimensional parts in mind. It must be an exact copy of your brand. Finally, you communicate exactly which goods and services you trade under your brand name. It is generally difficult to tell what is being offered from the name of a brand.

Why is registration important?

If you are going to sell goods or services in Jordan, it is best to register your brand name in this country right away. If you don’t, there is a chance that other companies or individuals will do this, or otherwise infringe on your unique brand. In Jordan, the first person to register a brand name is entitled to use that name. It is not forbidden to offer your goods and services in Jordan without registering your brand name, but then you do take the additional risks for granted. Third parties can start copying your exclusive brand and market a similar offering.

You may have worked for years to build a name and gain fame. So you want to clearly state that you are the owner of your exclusive brand, and that is only possible with a registration. By registering your trademark in Jordan, you avoid potential conflicts of ownership, while at the same time reducing the chances of goods and services being offered by third parties under a similar name. This way you do not miss out on unnecessary income without realizing it yourself.

t

What is the importance of a Trademark search?

Before you register your brand in Jordan, it is wise to first do a trademark search. This means that you actively look for existing brands in the region that resemble your unique brand. That way you can’t be surprised by a claim the moment you register your brand, and you can immediately see to what extent you can protect your brand name. Due to language differences, a trademark search in Jordan must be done in Latin.

How does registering different types of trademarks in Jordan work?

A brand name can consist of text, an image, or a combination of different external aspects. When applying for registration, you should always keep in mind that you are submitting an accurate copy of your trademark. You have to be careful if your trademark consists of different parts, because to protect individual parts of your trademark you have to submit separate applications.

If you don’t do this, everyone gets the chance to use and therefore abuse parts of your brand name. If such a situation arises, you can object. But this only has a chance of success in a situation of confusing resemblance. This means that a third party offers goods or services that are very similar to what you market. Whether an objection has a chance of success differs in each case, so to be sure it is best to handle the registration of your trademark with care.

t

What is the validity and how can you renew it?

A trademark can be registered in Jordan for a period of 10 years. This applies from the moment of application and the registration can be extended after the term, each time by 10 years. You can reapply from 12 months before the validity of your registration expires, until the last day of that month. This is followed by a postponement period of 12 months in which you can still renew the registration of your trademark, but you will pay an extra fee for this.

t

Where and in which cases to register your trademark?

It never hurts to have your brand name protected, especially if you intend to become a major player in the market. But what is the best place to focus on so that you don’t overlook anything? For example, do not only think about the country where you are located, but also register your brand in the countries where your production takes place.

Also research countries that could pose a potential risk to your brand. In which countries do you think your trade could be abused? In any case, secure your brand name here. Furthermore, it is best to register your trademark in countries where important competitors are located and in places where similar goods or services are regularly offered.
