How do you get a trademark registration in Cameroon?

To have your brand name protected and recognised, you must apply for registration with the African Intellectual Property Organization (OAPI). A few things are important. You must submit a duplicate of your trademark. Make sure it is an exact copy, so take into account striking shapes, specific colors or, for example, three-dimensional effects.

Of course you also have to share the data about your company. This includes a deed of incorporation or, for example, an extract from the Trade Register, but also a description of the services or goods you provide. In most cases, this cannot be deduced from the brand name itself.

t

Is a registration required?

If you are planning to expand your business and want to conquer the Cameroon market, it is wise to register your trademark in this country first. Failure to do so will give another company or individual the opportunity to appropriate that name or misuse your trademark in some way. In Cameroon the procedure is simple, whoever registers a brand name first will also receive all rights to use it. You can trade in Cameroon without registering a brand name, but if you do this you run unnecessary risks.

t

What is the value of a registered trademark in Cameroon?

You’ve done your very best to make a name for yourself with your business, and especially if you’re successful, people quickly want to take a piece of it. You must therefore be able to show the rest of the world that you are the rightful owner of the goods or services you provide. This is only possible by registering your brand in Cameroon.

Only by registering you can prevent possible problems about ownership in the future. Incidentally, you also have less chance that your brand will be copied and marketed under a similar name. You therefore run less risk of missing out on sales if you register your brand name.

t

Why is a trademark search prior to the trademark application recommended?

It is of course not desirable to be faced with surprises when applying for a registration, and certainly not much later. That is why it is best to first do a trademark search before you register your brand name in Cameroon. In a trademark search, it is checked whether there are already other brands in Cameroon that are similar to your own brand name. This way you immediately know what the possibilities are to protect your trademark in Cameroon.

t

Register combined marks

If your trademark does not consist of text or an image, but, for example, of a combination of these, you need to know what you are submitting with an application. In Cameroon, only what you hand in actually enjoys protection. If you also want to secure part of your trademark, you must submit a separate application for this.

If this does not happen, everyone will have the opportunity to take over part of your brand name without consequences and abuse it with all the consequences that entails. Fortunately, you can object to this, provided there are significant similarities between the other party’s merchandise and your brand. In that case we speak of a confusing resemblance. Whether an objection has any chance of success, however, always depends on the specific issue. So be sure of your exclusivity and protect your brand name.

t

Validity and renewal of registration

Your trademark is secured for 10 years from the moment you apply. You can extend the period several times by 10 years. try to do this before the registration expires. If that does happen, you have 6 months to still implement the extension, but you will pay a fee for this.

If you do not trade in Cameroon but have registered a trademark, you should also pay attention. You run the risk of losing your brand name protection if you have been inactive for too long. However, you can easily prevent this by showing activity every now and then.

t

Where and when to register?

You must in any case secure your mark in the country where you are located, that goes without saying. But also think about the countries where your production takes place.

You can also investigate which countries potentially pose a risk to your trademark. Where is an increased risk of abuse? Finally, it is smart to protect your brand in countries where the larger competitors are active and in places where your merchandise is traded a lot.
