How do you get a trademark registration in Uzbekistan?
In principle, a trademark registration in this country consists of two phases. The registration process can start upon completion of the search. The first phase takes on average two months. At this time, the Intellectual Property Agency conducts the formal investigation, examining the application forms and documents for accuracy, completeness and conformity. If information is missing, the agency will contact you and the process may be delayed. The second phase will take approximately six months to complete. This phase is only executed when phase 1 is successfully completed. In this second phase, the substantial examination takes place, in which the trademark itself is inspected. Does it appear at this stage that the trademark does not meet all the criteria? Then registration can still be refused.

Trademarks are covered in Uzbekistan under Article 3 of the Trademarks Act. This only applies if the trademark has actually been registered according to the established procedure to be followed in Uzbekistan.
Is trademark registration in Uzbekistan really necessary?
We can be short and sweet about this: yes. You want to benefit from the protection of your trademark and this absolutely requires trademark registration in this country. Uzbek law clearly states that the designation must be registered in an established manner in order to have legal force in itself. In practice, we see that under no circumstances are trademarks protected if there is no proper registration with the Intellectual Property Agency of Uzbekistan. This agency is the main body responsible for the regulation and control of trademarks and patents.
As a rule, trademarks must meet two basic and essential criteria in order to be legally valid. Firstly, trademarks must have a distinctive character, ie a beautiful name or graphic design, and secondly, the trademark must have a new character. This means it must be different from other trademarks.
What can a trademark registration in Uzbekistan consist of?
In Uzbekistan, the trademarks are subdivided into various variants, with particular attention being paid to the various elements. It is possible that several elements are combined. The following elements are possible, among others:
Two important rights in trademark registration in Uzbekistan
The rights you receive when registering a trademark differ per country. It is therefore always important to take a good look at which rights you get when registering a trademark, and which you do not. In Uzbekistan you basically get two important rights if you opt for trademark registration. The essence of trademark rights in this country includes the exclusive right of use and preventing third parties from using the trademark. Registration of rights to a trademark in a legal system is usually recognized as a mandatory procedure that the rightholder must follow in order to obtain exclusive rights to his trademark and their legal enforceability.
Does one need a trademark search?
It is highly recommended that you archive documents to conduct a search before starting your trademark registration process. It searches for trademarks that have already been registered or applied for registration, both nationally and internationally. The search helps to identify the risks and potential disputes that may arise in relation to the registration of certain trademarks. This search must be submitted to the Intellectual Property Agency in Uzbekistan. You pay a fixed price for this and it is important to provide the correct documents, including a list of trade names to search for.
What is the validity of a trademark registration in Uzbekistan?
When the registration procedure has been completed and your trademark is properly registered in the country, it is important to keep an eye on its validity. A trademark registration in Uzbekistan is standard valid for a period of 10 years and can be extended for another 10 years. Without trademark registration, you do not have any rights to the trademark in this country, making it relatively easy for third parties to use the trademark for identical services and/or products.
