How do you get a trademark registration in Yemen?
You can register your brand name with the Institute of Intellectual Property of Yemen (YIPO). To submit an application, you need to share certain information with YIPO. First of all, you must transfer a copy of the deed of incorporation or an extract from the Trade Register. This should contain contact details such as the name, address and purposes of the person making the request. You will also submit a representation of your brand, along with a list of the goods or services you trade under that brand.
The first to use his or her brand name in the region has the rights to that name. Registration is therefore not mandatory, but in practice it is wise to do so anyway. This prevents you from having to deal with brands that resemble your unique brand, and you prevent copying behavior from third parties.
What are the requirements for a trademark search in Yemen?
Before registering your trademark in Yemen, it is best to conduct a trademark search. This way you can see which other brands already exist and whether or not they resemble your brand name. This way you will not be faced with unpleasant surprises when it is already too late, and you will know to what extent you can protect your brand name. Please note, a trademark search must be done in Latin due to the language barrier.
Registering different kinds of trademarks in Yemen

How long is the validity and how does renewal of your registration work?
A registered trademark is valid in Yemen for a period of 10 years from the date of application. You can extend the registration indefinitely, each time for a period of 10 years. You can apply for an extension from 6 months before the registration period has expired, and until the last day of the month in which the registration is no longer valid. After this, there is a deferral period of no less than 12 months in which your trademark registration can still be renewed, but you will pay an extra fee for this.
If you register a brand name while you are not selling any products in Yemen at all, you have to take into account a different procedure. You can register your trademark in Yemen without using it, but the protection of your registration is compromised if you are inactive for more than 5 years. In such a situation, your registration may be canceled due to lack of use. You can prevent this by at least being as minimally active with your brand as possible.
